1. Introduction

These Terms & Conditions (“Terms”) govern your use of the services provided by Reef Support B.V. (“we”, “us”, “our”), a company registered in the Netherlands.

By accessing or using any of our platforms, you agree to be bound by these Terms. If you do not agree, you must not use our services.

These Terms apply to all Reef Support services:

  • MariMap — marine monitoring platform (marimap.reef.support)
  • MariField — mobile field data collection app
  • Reef Ranger — conservation travel platform (travel.reef.support)
  • reef.support — main website, documentation, and all subdomains

2. Definitions

  • “Services” — all platforms, applications, websites, and tools provided by Reef Support B.V.
  • “User” — any individual or organisation that accesses or uses our Services
  • “Account” — a registered user profile on any of our platforms
  • “User Content” — any data, text, images, survey data, or other materials you upload or create through our Services
  • “Monitoring Data” — survey observations, species data, GPS coordinates, photographs, and other scientific data collected through MariMap or MariField

3. Account Terms

3.1 Account Creation

To use certain features, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Not share your account credentials with others
  • Not create multiple accounts for the same person

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorised use of your account.

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Misuse our platforms or interfere with other users
  • Fail to respond to security-related notifications

4. Acceptable Use

4.1 Permitted Use

You may use our Services for:

  • Marine monitoring, conservation research, and ecological data collection
  • Viewing and analysing marine environmental data
  • Planning and booking conservation travel experiences (via Reef Ranger)
  • Educational and non-commercial research purposes
  • Any other lawful purpose consistent with the intended use of our platforms

4.2 Prohibited Use

You must not:

  • Use our Services for any unlawful purpose
  • Upload false, misleading, or fabricated monitoring data
  • Attempt to gain unauthorised access to our systems or other users’ accounts
  • Reverse-engineer, decompile, or disassemble any part of our software
  • Use automated tools (bots, scrapers) to extract data without permission
  • Interfere with or disrupt the operation of our Services
  • Upload content that infringes intellectual property rights of others
  • Use our platforms to distribute malware, spam, or harmful content
  • Impersonate another person or organisation
  • Circumvent any access controls or security measures

4.3 Enforcement

Violations of the acceptable use policy may result in:

  • Warning notification
  • Temporary suspension of access
  • Permanent termination of your account
  • Reporting to relevant authorities where required by law

5. Data Ownership and Rights

5.1 Your Data

You own your data. All Monitoring Data, survey observations, and User Content you create or upload through our Services remains your property.

By using our Services, you grant Reef Support B.V. a non-exclusive, worldwide licence to:

  • Store, process, and display your data as part of providing the Services
  • Create anonymised and aggregated datasets for conservation research and reporting
  • Back up your data for service continuity and disaster recovery

This licence exists solely to enable us to provide the Services and does not transfer ownership of your data.

5.2 Data Export

You have the right to export your data at any time. We provide data export functionality in MariMap and MariField that allows you to download your Monitoring Data in standard formats (CSV, GeoJSON, and other commonly used formats).

5.3 Data Deletion

Upon account deletion or request, we will delete your personal data in accordance with our Privacy Policy and applicable data retention requirements.

5.4 Shared and Public Data

If you choose to share data publicly or with other users:

  • You are responsible for ensuring you have the right to share that data
  • Other users may view and use shared data in accordance with the sharing permissions you set
  • Once data is shared, recipients may retain copies even if you later revoke access

5.5 Aggregated Data

We may create anonymised and aggregated datasets derived from user-contributed Monitoring Data for the purpose of marine conservation research, environmental reporting, and scientific publications. Such aggregated data will not identify individual users.

6. Intellectual Property

6.1 Our Intellectual Property

All intellectual property rights in the Services, including but not limited to software, design, logos, trademarks, and documentation, are owned by Reef Support B.V. or its licensors.

You are granted a limited, non-exclusive, non-transferable licence to use our Services in accordance with these Terms.

6.2 Open-Source Components

Our platforms may include open-source software components, each governed by its respective open-source licence. Nothing in these Terms restricts your rights under applicable open-source licences.

6.3 Feedback

If you provide feedback, suggestions, or ideas about our Services, you grant us the right to use that feedback without restriction or compensation.

7. Service Availability

7.1 Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. Our Services may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unplanned outages or technical issues
  • Force majeure events beyond our control

7.2 Modifications

We reserve the right to modify, update, or discontinue any part of our Services at any time. For significant changes, we will provide reasonable advance notice.

7.3 Offline Functionality

MariField is designed to function offline for field data collection. Data collected offline is stored locally on your device and synchronised when connectivity is restored. We are not responsible for data loss due to device failure before synchronisation occurs.

8. Fees and Payment

8.1 Free and Paid Services

Some of our Services are provided free of charge, while others may require payment. Pricing, where applicable, will be clearly communicated before any purchase or subscription.

8.2 Changes to Pricing

We may change our pricing with at least 30 days’ advance notice. Existing subscriptions will honour the current pricing until the end of the billing cycle.

9. Limitation of Liability

9.1 Disclaimer

Our Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Limitation

To the maximum extent permitted by law, Reef Support B.V. shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Damages arising from your use of or inability to use our Services
  • Damages arising from the actions or content of third parties

9.3 Maximum Liability

Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.

9.4 Scientific Data Disclaimer

Monitoring Data displayed on our platforms is contributed by users and is not independently verified by Reef Support B.V. We do not guarantee the accuracy, completeness, or reliability of any Monitoring Data. Users should exercise their own judgement when relying on such data for scientific or decision-making purposes.

10. Indemnification

You agree to indemnify and hold harmless Reef Support B.V., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any User Content you submit through our Services

11. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us at [email protected] or using the account deletion feature in your settings.

12.2 By Us

We may terminate or suspend your account for any reason with reasonable notice, or immediately in the case of a serious breach of these Terms.

12.3 Effect of Termination

Upon termination:

  • Your right to access the Services will cease
  • We will retain your data for the period specified in our Privacy Policy
  • You may request data export before or within 30 days after termination
  • Provisions that by their nature should survive termination will continue to apply (including sections on intellectual property, limitation of liability, indemnification, and governing law)

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law provisions.

13.2 Dispute Resolution

In the event of a dispute, we encourage you to contact us first at [email protected] to seek an amicable resolution.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

13.3 EU Online Dispute Resolution

If you are a consumer in the EU, you may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Reef Support B.V. regarding your use of the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, pandemic, government action, or infrastructure failures.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting an updated version on our websites
  • Sending an email notification for significant changes
  • Updating the “Last updated” date at the top of this page

Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
